GARAN Terms of Service

These Terms of Service ("Terms") govern use of the GARAN Shopify app ("GARAN", "the App"), provided by Optimmerce ("we", "us", "our"). By installing GARAN, you ("Merchant", "you") agree to these Terms.
1. What GARAN does
GARAN helps merchants display the EU's harmonised legal-guarantee notice and the GARAN durability label on their Shopify storefront, as introduced by Directive (EU) 2024/825 and detailed in Commission Implementing Regulation (EU) 2025/1960, and provides tools (a per-product editor and a bulk editor) to enter and manage the underlying guarantee data.
GARAN is not legal advice. It is a display and data-management tool. You are solely responsible for:
- the accuracy of the guarantee data you enter (duration, brand, model identifier, and whether a guarantee is offered at all);
- determining whether and how the EU notice/label requirements apply to your business and products; and
- your own compliance with Directive (EU) 2024/825, Regulation (EU) 2025/1960, and any other applicable law.
We recommend consulting a qualified professional if you're unsure how these rules apply to you.
2. Plans and billing
GARAN offers a Free plan and a paid Pro plan. Current pricing, trial length, and feature differences are shown on the in-app plan selection page, which is hosted and billed entirely through Shopify (Shopify App Pricing) — we never receive or store your payment details. Subscribing, changing, or cancelling a plan is done through that Shopify-hosted page.
3. Your account and data
You're responsible for maintaining accurate guarantee data and for who on your team has access to your Shopify admin (and therefore to GARAN). See our Privacy Policy for what data we collect and how it's handled.
4. Acceptable use
You agree not to use GARAN to:
- enter guarantee data you know to be false or misleading;
- attempt to reverse-engineer, disrupt, or gain unauthorized access to GARAN or the systems it runs on; or
- use GARAN in a way that violates applicable law.
5. Availability and changes
We aim to keep GARAN available and working correctly but don't guarantee uninterrupted availability. We may update, add, or remove features over time, including to keep pace with changes to the underlying EU regulation.
6. Disclaimer of warranties
GARAN is provided "as is," without warranties of any kind, express or implied, including any warranty that it fully or permanently satisfies your legal obligations under Directive (EU) 2024/825 or Regulation (EU) 2025/1960. Regulatory requirements and their interpretation may change; you're responsible for staying current.
7. Limitation of liability
To the maximum extent permitted by law, Optimmerce is not liable for indirect, incidental, or consequential damages arising from your use of GARAN, including regulatory penalties resulting from inaccurate guarantee data you entered or from your own compliance decisions. Our total liability for any claim relating to GARAN is limited to the amount you paid us in the 12 months before the claim arose.
8. Termination
You can uninstall GARAN at any time. We may suspend or terminate access if you violate these Terms. Sections 6, 7, and 9 survive termination.
9. Governing law
These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles.
10. Changes to these Terms
We'll update the "last updated" date above if these Terms change, and post the updated version at this same location. Continued use of GARAN after a change means you accept the updated Terms.
